Registration on the Site owned and managed by Elementz 4 Real and any subsequent use of the services rendered by Elementz 4 Real through the Site, including the booking, purchase, issue and shipment of clothing (so-called"marketing service") and the information service relating to events on sale, sales opening dates and other information related to such events will involve the processing of personal data concerning youTherefore, in compliance with the provisions of EU Regulation 2016/679, General Data Protection Regulation (cd"RGPD") and of the Privacy Code, if and to the extent applicable, we hereby intend to inform you that the Company, as owner of the Site and as Data Controller, will process your personal data under the following conditions.

For the purposes indicated in this statement, the Company does not collect or process personal data attributable to the Customer that the RGPD qualifies as"particular categories"(such as, by way of example, data suitable for revealing racial and ethnic origin, religious beliefs , philosophical or otherwise, political opinions, membership of associations or organizations of a religious, philosophical or trade union nature, as well as personal data suitable for revealing the state of health) or data relating to criminal convictions and offenses.
Art2Legal basis and purpose of the processing
The processing of personal data (including their registration in the Company's records) is based on the existence of a contractual or legal obligation or, depending on the case and as better specified in the following paragraph, on the existence of a legitimate interest of Elementz 4 Real or on your consent, optional and revocable at any time, and is aimed exclusively at achieving the following purposes:
a) in fulfillment of contractual obligations [art6 lettb) RGPD] - to guarantee registration on the Site and the correct provision of the services requested from Elementz 4 Real through the Site and/or through the forms and tools made available there, including the marketing service and the newsletter service, and, therefore, to correctly and punctually fulfill all the obligations deriving from the respective pre-contractual and contractual relationships established with youThe administrative and accounting purposes connected and in any case deriving from the contract concluded with you are expressly included, also with regard to the possible transmission by e-mail of commercial invoices by Elementz 4 Real and/or companies connected to it in the provision of the marketing service (including, by way of example, the procedure for reimbursing the price paid and issuing a credit note following the cancellation of an item already purchased)This context also includes the service provided by the Assistance Service and, therefore, the processing of the user's personal data for the management and sending of responses to requests for assistance in relation to one or more of the services available on the Site;
b) in fulfillment of legal obligations [art6 lettc) GDPR] - for the fulfillment of obligations deriving from the law or regulations, national and/or EU, in force, in particular, in the fiscal field, as well as public security and in the field of"secondary marketing", as well as provisions issued by competent authorities and bodies;
c) by virtue of a legitimate interest of Elementz 4 Real [art6 lettd) GDPR] consisting in the defense in court of a right or interest before any competent authority or body, expressly included therein for the purposes of credit recovery; to allow Elementz 4 Real to offer similar products or services directly (so-calledsoft spamming) to those object of a previous purchase, limited to the e-mail coordinates provided by you in the context of the purchase of a service through the Site and subject to your opposition to such treatment for the organizational management of the purchased garment or in any case of services accompanying the latter, such as, by way of example, for the detection of the degree of customer satisfaction with the quality of the services rendered and the activity carried out by Elementz 4 Real and the carrying out statistical analyzes and market surveys on aggregate data;
d) on the basis of your consent [art6 letta) GDPR] - for functional and instrumentally connected purposes with the activity of Elementz 4 Real, such as:
- the sending of advertising material relating to products and/or services of Elementz 4 Real and/or third parties, by means of automated systems, such as e-mail, fax, sms or MMS, or by traditional methods (paper mail) (cdmarketing purposes);
Art3Provision of data and consequences in case of failure to provide it
The provision of data for the purposes referred to in points a) (fulfillment of contractual obligations), b) (fulfillment of legal obligations) and c) (legitimate interest of Elementz 4 Real) of art2 above is purely optionalHowever, since this processing is necessary to allow registration on the Site and the provision by Elementz 4 Real of the services it offers through the Site, including the marketing service and the newsletter service, the failure, partial or incorrect provision of the data in question will make it impossible, depending on the case, to register on the Site and to use the services provided online by Elementz 4 Real through the Site and, in general, to initiate the contractual relationship by establishing or established and/or fulfill the obligations as required by the contract or applicable law or, again, to fulfill your specific requests, as well as the impossibility for the Company to send you general information on products or services similar to those of a previous purchase, to carry out market surveys , also aimed at assessing the degree of user satisfaction and thus improving their services, or in any case to pursue their legitimate interests i (such as the defense in court of one's own right).

• to couriers or shippers in charge of delivering the products purchased through the Site;
• to companies in charge of processing and/or sending advertising and information material on behalf of our Company;
• to other companies belonging to our Group, having offices in Italy, which will be able to process them exclusively as external managers of the processing of personal data on behalf of Elementz 4 Real

Art6Retention of personal data
The personal data concerning you will be kept only for the time necessary to guarantee the correct provision of the services offered by our Company and, in particular, as specified below:
• In the event of cancellation, exclusion or disabling due to non-use of your account on the Site, your data will be kept for administrative purposes for a period not exceeding one quarter, without prejudice to any specific legal obligations on the conservation of accounting documentation or for of public safetyIn such cases, the deletion of the data will also be guaranteed by the appointed managers to whom they may have been communicated.

More specifically, the user is advised that:
